TERMS OF SALE

ALL SALES BY Liberty CAD ARE MADE SUBJECT TO THE FOLLOWING TERMS, CONDITIONS, AND SALES POLICIES, PLEASE READ.

1. Unless other terms and conditions are expressly accepted by Liberty CAD, (hereinafter called "the Company") by means of a written amendment to these terms of sale signed by the proprietor of the Company and referring specifically to the terms and conditions to be amended, the contract shall be on the terms set out below (hereinafter called "the Contract") to the exclusion of any other terms and conditions.

2. WARRANTIES: There are NO warranties that extend beyond the description on this page. seller disclaims any warranty, expressed or implied, that the goods and/or services are merchantable. Provisions set forth in the specifications are descriptive and subject to change and are not intended as warranties.

3. CONSEQUENTIAL DAMAGES: The Company will not be responsible for any consequential damages resulting from the use of any of its products and/or services supplied herein.

4. DELIVERY AND SHIPPING: Shipping dates are approximate and are subject to delays from causes of contingencies beyond the reasonable control of the Company. When not otherwise specified shipment will be made in standard containers via carrier which in the judgment of the Company, will result in the most practical method. An extra charge will be made for any specified special containers. Title and right of possession will pass to you upon delivery to carrier at F.O.B. Cheyenne, Wyoming or otherwise shipped by the Company. If any shipment or work to be performed is delayed by the purchaser, all payments shall be due on schedule based on expenses or commitments made.

5. PRICES AND PAYMENTS: All prices are F.O.B. Cheyenne, Wyoming. Due to possible increases in cost of labor and material, this merchandise will be billed at price in effect at time of shipment unless otherwise specifically agreed upon in writing. Standard terms of payment are 2% 10 net 30 days. The Purchaser agrees to pay a service charge of 1-1/2% per month on all sums due which are not paid within forty-five (45) days from date of invoice. However, if in the judgment of the Company, the financial condition of the Purchaser at any time does not justify production or shipment according to the standard terms of payment, the Company may require full or partial payment in advance or shall be entitled to cancel the order. The Purchaser agrees to and shall pay to the Company all expenses incurred by the Company in collecting any moneys due from the Purchaser hereunder, including reasonable attorney's fees.Liberty CAD also accepts Check By Fax - Click Here for for more details.

6. DRAWING BLOCKS AND SYMBOLS: Seller shall retain title and right of possession to all standard drawing blocks and symbols produced by the Company unless otherwise specifically agreed upon in writing.

7. RETURNS: Due to the special nature of products manufactured by the company it is uneconomical to accept any return for salvage consideration. No credit will be issued in such case.

8. CANCELLATION: The Purchaser may cancel his or her order only upon written notice and upon payment to the Company of reasonable and proper cancellation charges, which shall take into account expenses already incurred and commitments made by the Company.
